1.The agreement

1.1These online terms and conditions represent the entire agreement between you and Arthibition in relation to the subject matter of any contract. These online terms and conditions supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

1.2If one party does not fulfill his contractual promise, or has given information to the other party that he will not perform his duty as mentioned in the contract or if by his action and conduct he seems to be unable to perform the contract, he is said to breach the contract.

1.3Your order constitutes an offer to the Arthibition to buy Goods and/or Services. All orders are subject to acceptance by the Arthibition and such acceptance will be by way of email confirming payment has been received for the Goods and/or Services (the purchase confirmation). The contract between you and the Arthibition will only be formed when you are sent the purchase confirmation.

1.4These terms and conditions and the distant selling regulations apply to all purchases of Goods and/or Services from Arthibition online gallery. Please read these terms carefully before using this website. Using this website or placing an order indicates that you accept these terms.

2.Terms & Conditions

2.1When you purchase Goods or Services from this Website you agree to be bound by these online terms and conditions which govern your use of the Arthibition website. The online terms and conditions of this Website will always prevail over other terms and regulations.

2.2Arthibition may vary the online terms and conditions at any time.  Your continued use of the Website following any variation to the online terms shall be deemed to be acceptance of any variation.

2.3If you do not accept these terms and conditions in full, you must leave this Website immediately. These terms shall apply every time you buy Goods or Services from the Arthibition.

3. Customers

3.1The Arthibition Website is for use by Iran and oversea residents.

3.2Goods and Services ordered from the Arthibition Website for delivery outside Iran may be subject to import duties and taxes or handling charges which are levied when the delivery reaches the country of destination.  Arthibition does not have any control over these charges and cannot predict their amount. Payment of any such charges, taxes or import duties will be your responsibility and you must comply with the applicable laws and regulations held within the destination country.  Please check with your local customs office for further information prior to placing your order.

4. Availability  

4.1You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website may only open to you if you register. Access is given to this Website in accordance with these online terms. 

4.2You are asked to comply with the registration process. Each registration is for a single user only. Arthibition does not permit you to share your user name and password with any other person nor with multiple users on a network.

Responsibly for the security of any passwords issued rests with you.

4.3You warrant that in using the Arthibition' Website and completing the online registration you will not impersonate any other person, use a false name or, without proper authority act for any other person or organization.

4.4 You are prohibited from posting or transmitting to or from this Website any material:

4.4.1 that is threatening, defamatory, indecent, offensive, abusive, discriminatory, scandalous, inflammatory, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience; 

4,4.2 for which you have not obtained all necessary licenses and/or approvals; 

4.4.3 which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in Iran or any other country in the world; or 

4.4.4 which is technically harmful (including, without limitation, computer viruses, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data). 

4.5 You may not misuse the Website (including, without limitation, by hacking). 

4.6 Arthibition will fully co-operate with any law enforcement authorities or court order requesting or directing the Arthibition to disclose the identity or locate anyone posting any material in breach of the mentioned issues.

4.7 While the Arthibition ensures that this Website is normally available 24 hours a day, the Arthibition will not be liable if for any reason this Website is unavailable at any time or for any period.

4.8 Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair beyond the Arthibition control. 

5. Fraud

5.1 The Arthibition reserves the right to take legal action against committing or attempting to commit online fraud.

6. Payment

6.1 Prices and any additional related charges (where applicable) are published at the Arthibition Website for the relevant Goods and/or Services on the date of your order.

6.2 Arthibition accepts no liability for any loss or damage, arising directly or indirectly as a result of a payment being refused or declined.

6.3 Confirmation of your payment will be displayed on screen once it has been authorized and accepted.  You will also receive confirmation of the transaction to the email address you have provided.

6.4 We reserve the right to refuse to process payments.

7. Delivery

7.1 Arthibition will deliver the Goods to the Delivery Address you gave when you placed the order.

8. Cancellations

8.1 If for any reason the Arthibition is unable to supply the Goods and/or Services you have ordered any charges incurred will be refunded.

8.2 If the Goods and/or Services are not what you originally ordered or are damaged or defective, the Arthibition will either (at your request) refund you the amount you paid for the products or replace the products you received with products which conform to those ordered. You will need to return the original item before a refund can be issued or a replacement sent.

8.3 You have the right to cancel the contract and return Goods and/or Services up to one working day after receiving the goods. Arthibition will refund the cost of the Goods and/or Services returned providing that there is acceptable reason but it is not obliged to refund the cost of postage and packing.  Any refund will be made provided that the Goods and/or Services are in the same conditions as they were at the time of purchase.

8.4 You do not have the right to cancel the contract once the performance of any Services has commenced with your agreement prior to the end of the cancellation period. 

8.5 you must take reasonable care of the products while they are in your possession, and ensure that they are returned in the same condition as when they were received by you.

9.Data protection policy

9.1Any personal data collated through the Arthibition Website will be treated confidentially, and will only be used to process your order and for statistical analysis to continually improve the Website and its Services to you, and to service the Website.

9.2Data may be shared with the police, the government or any other legal authority investigating suspected legal activities if there is an official request.

10. Indemnity

10.1 As a customer you agree to indemnify the Arthibition against all claims, damages and expenses arising out of any breach of these online terms and conditions and other liabilities arising out of your use of the Arthibition Website.

11. Complaints

11.1 If there is an occasion where an issue has not been resolved to your satisfaction you may wish to contact Customer Services regarding your complaint.

11.2 Complaints will be dealt with in adherence to the Arthibition complaints policy

12. Law

12.1 These online terms and conditions shall be governed by and construed in accordance with the laws of Iran and any disputes will be decided by the judiciary system.

13. Liability

13.1 Arthibition will not be liable in contract, or pre-contract representations or otherwise, for any economic losses, loss of goodwill or reputation, or special indirect losses incurred by you or any third party arising out of or in connection with these online terms and conditions.

13.2Arthibition will not be held responsible for any delay or failure to comply with its obligations under these online terms and conditions if the delay or failure arises from any causes which is beyond its reasonable control including natural disasters like flood, earthquake, Hurricane, etc.
